Debt Collectors and the Telephone Consumer Protection Act

It is a myth that popular media sources are circulating about debt collectors and the Telephone Consumer Protection Act. Several have claimed that automated messages from collection agencies to consumers leaving automated recordings is not illegal.

This is not true. If a collection agency is using any type of software to call your cellphone they have violated the Telephone Consumer Protection Act.

If you are receiving calls from Federal Bond and Collection Service to your cellphone with a robo dialer they may be liable to you under the Telephone Consumer Protection Act. (TCPA)

The TCPA makes it illegal to call a cellphone with a predictive dialer. This means that even if a person initiated the call and did not pick up the phone or use some form of manual dialing device to call your cell phone then they have violated the telephone consumer protection act.
